Nick Carter said in legal papers filed in Nevada that it was logically impossible for him to have sexually assaulted Shannon Ruth over 20 years ago. He backed up his claim with testimony from 9 different people, including his security and management team at that time. He also asked for a hearing and requested a quick decision on Ruth’s lawsuit.
Carter’s legal motion includes the names of Melissa Schuman, her father Jerome, the @ElaineMoo Twitter account, and YouTuber Alexa Nikolas. Schuman sued Carter for sexual assault and battery in April 2023.
Ruth sued Carter In December 2022, Schuman sued Carter for sexual battery, intentional infliction of emotional distress, and negligent infliction of emotional distress. She said Carter assaulted her on his tour bus after a Backstreet Boys concert in 2001 when she was 17. Ruth also claimed she was given alcohol and contracted HPV from the assault.
The filing stated that all allegations of sexual assault against Carter were planned by Melissa Schuman, Jerry Schuman, Ashley Repp, and Ruth to gain fame and extort money from Carter. Carter refused to meet any of their demands and is determined to expose them as what he called con artists and criminal partners.
In another part of the legal filing, it was mentioned that Ruth's best friend at the time, Eleanor Brewer, was supposed to support her story. However, Brewer testified that it was not true and that she had never gone to any medical appointment with Ruth. The evidence also showed that Ruth had tested negative for HPV according to her medical records.
“Ruth was coached and groomed by Melissa and Jerome Schuman. Ruth did not say that Carter sexually assaulted her until the Schumans were involved for ten months.”
Ruth testified her best friend at the time, Eleanor Brewer, would corroborate her account. However, Brewer testified that none of that was true and that she had never attended any medical appointment with Ruth. Additionally, evidence confirms that Ruth tested negative for HPV based on her own medical records.

Nick Carter challenged Ruth’s claim based on the band’s schedule at the time. Band management and the security team at the time confirmed that the band left quickly after the concert and went directly to their hotel. These details were supported by Susan Riggs, a friend of Carter’s, and an online review of the concert posted on the Backstreet Boys’ website at the time.
The tour manager at the time, Tom Hudak, testified that Ruth’s claim that Nick Carter stayed at the venue and invited her onto his tour bus was false. He also said that all band members, including Nick Carter, left the venue after the show and that fans did not have access to the tour bus staging area, which was always guarded by security guards, making it impossible for her to get on the bus before they left.

Carter has asserted that “Ruth was coached and groomed by Melissa and Jerome Schuman [and] Ruth did not claim that Carter sexually assaulted her until the Schumans had their claws in her for ten months.”
The document said, "Carter should be able to get a decision in this case without going to trial, and the plaintiff hasn't provided any reliable evidence to support her claims."
A summary judgement means a judge makes a decision without a trial by jury, and Ruth's legal team must share their evidence with Carter's.
Carter was also sued accused Carter of sexual assault in August 2023. In the legal paper, a person named A.R. claimed that Carter assaulted her multiple times on a yacht and once on a tour bus.
Melissa Schuman previously came forward with her claim against Carter in 2o17 in a since-deleted blog post. She accused Carter of raping her in 2003 in his home in Santa Monica. She was 18 and a virgin at the time.
Carter strongly denied the accusation. He said, "I am shocked and saddened by Ms. Schuman’s accusations. Melissa never expressed to me while we were together or at any time since that anything we did was not consensual."
"We went on to record a song and perform together, and I was always respectful and supportive of Melissa both personally and professionally. This is the first that I am hearing about these accusations, nearly two decades later. It is contrary to my nature and everything I hold dear to intentionally cause someone discomfort or harm," he concluded.
