The All Progressives Congress' spokesperson, Felix Morka, restated on Thursday that the party will not follow the initial court ruling that confirmed Dr Abdullahi Ganduje's suspension as national chairman.
He also repeated that the party's national chairman has not been formally notified about the initial court ruling that stopped him from holding the position.
Morka, who appeared on Arise TV, confirmed that they are supporting the recent decision of the Kano Federal High Court to put a hold on the order.
The political situation in Kano changed on Wednesday when another judge, Justice A.M Liman, stopped the alleged suspension of Ganduje by his ward executives in Dawakin Tofa Local Government area.
The ruling was issued after Ganduje filed a request to protect his right to a fair hearing.
The application's respondents are the Nigerian Police, Department of State Services, Nigeria Security and Civil Defence Corps, and nine other individuals.
Morka argued that it was the right thing to do because those behind the suspension were not recognized members of the party.
He said, “The order from the first court was very troubling for a few reasons. First, the people who filed the action are not acknowledged members of our party and should not have the authority to request such an order from the court.
“Secondly, every lawyer knows that judges should not make far-reaching orders without hearing both sides.
“When a case could cause substantial harm to the defendant, the defendant should be informed even in an emergency application so justice can be served.
“But this judge, in this situation, confirmed the illegal suspension of the national chairman based on an emergency application, which shouldn’t have happened.
“As a lawyer, I respect the court and won't say much. Nevertheless, the Kano State High Court order confirming the suspension of our national chairman has not been officially given to the party or the national chairman.
“So, all discussions regarding this matter have been based on media reports. We haven't received official notice of the order. Therefore, we can't react to it or decide whether to respect it because we have not been served. Meanwhile, the Federal Court has issued an order preventing the individuals who initiated the suspension from enforcing it.
“At the moment, we are back to where we were before the supposed suspension of Ganduje as the national chairman. He still holds the position.”
