The lawyer for Gain’s parents, Bryan M. Kaemmerer, gave an update on her medical condition in an April 1 statement, which was emailed to Heavy.
A video that spread widely online shows a teenage girl hitting Gain’s head against the ground during a fight. Gain was attacked on March 8 near Hazelwood East High School in Missouri. The 15-year-old suspect has been charged with assault.

Attorney Says Kaylee Gain’s Walking Ability Has Slightly Improved
The lawyer’s statement included more information about Gain.
“Kaylee’s ability to walk has slightly improved, but she needs help from the hospital staff. Her cognitive impairment is still evident during her limited conversations, as she tends to repeat the same short sentences over and over. Although Kaylee seems to understand that she is in the hospital, she doesn’t know why,” he wrote.
Kaylee’s parents thanked the treating physicians and hospital staff for their compassion during her recovery.
The family’s lawyer mentioned that some family members attended the accused’s hearing, but couldn’t share details due to confidentiality in the juvenile court system.
However, the family is encouraged by public statements from those associated with the accused expressing a desire to apologize to Kaylee. Although this doesn’t change the family’s position about trying the accused as an adult, it’s reassuring that the accused seems remorseful for the events.
Kaylee Gain’s Family Acknowledges Falsely Attributed Social Media Posts to the Suspect
The lawyer clarified that the family no longer believes that social media posts attributed to the suspect were actually written by her.
The family also wants to acknowledge that the social media posts from an account with the suspect's name do not seem legitimate based on new details about the timing of the accused’s arrest, her lack of access to her phone after being taken into custody, and metadata showing the initial publication times of the posts.
“The events that occurred in the hours and days after the family became aware of Kaylee’s attack, including when they first learned of these social media posts, are understandably hard to remember due to their shock and sadness. The family is relieved that the accused did not post these offensive messages. However, they still firmly believe that there is enough evidence to try the accused as an adult.”
