TikTok and its parent company ByteDance have taken legal action against the US government in a filing on Tuesday, claiming that the ban on the Chinese-owned social media platform breaches the First Amendment rights of American users.
The lawsuit, which TheWrap obtained, stated, “For the first time ever, Congress has passed a law that puts a permanent, nationwide ban on a specific, named speech platform, and prevents every American from participating in a unique online community with over 1 billion people globally.”
President Joe Biden signed the Protecting Americans from Foreign Adversary Controlled Applications Act on April 24 as part of a significant foreign aid package approved by Congress.
ByteDance mentioned in its filing that the law, known as the Protecting Americans From Foreign Adversary Controlled Applications Act (the “Act”), is against the constitution.
There was no immediate response from the White House.
