The police charged Tate with first-degree murder, aggravated vehicular hijacking, and possession of a stolen firearm.

According to CPD Chief of Detectives Antoinette Ursitti, detectives found video evidence of Tate in the shooting area and traced his movements to a store where he used a relative's bank card to buy a bottle of water. The relative then identified Tate to the police, Ursitti stated.
Huesca's stolen car was found, and the water bottle and the clothing Tate wore on the day of the shooting were found nearby. Ursitti mentioned that Tate's DNA and fingerprints were discovered on the evidence.
NBC Chicago reported that Officer Huesca was shot and had his SUV stolen as he was returning home from work. Detectives tracked Tate to an apartment in Glendale Heights, Illinois on Wednesday night, May 1, and arrested him using Huesca's handcuffs, according to Chief Snelling.
Snelling recounted that ballistics evidence definitively linked Tate to the murder.
On April 26, Chicago police issued a community alert.
An arrest warrant for Tate Jr., 22, was announced in the alert, describing him as the suspect wanted for the murder of Officer Huesca. The community alert was issued on April 23, declaring that the suspect should be considered armed and dangerous. “My Office of Community Safety, in collaboration with Supt. Larry Snelling and the Chicago Police Department, is committed to using every available resource to catch anyone involved in this morning’s shooting and bring them to justice. As the investigation continues, we will provide immediate updates as they become available,” it adds.
