Property and family lawyer, Onifade Olamide, believes that Joseph Aloba, the father of the late singer Mohbad, does not have the legal right to request a DNA test for his grandson, Liam.
The paternity of Liam, the late Mohbad's only child, has been disputed since his sudden death.
The Chief Magistrate Court in Ikorodu granted an order to serve notice of the pending test application to Wunmi, the late singer's widow, using substituted means. DNA The order was mentioned in a statement signed by Monisola Odumosu, a member of the Aloba family's legal team, which was obtained by PUNCH Online last week.
The Aloba family's legal team, led by Emmanuel Oroko, filed an application seeking to serve Wunmi by posting all the relevant documents on her last-known address.
According to the statement, the legal team argued that the sheriff had tried and failed twice to serve Wunmi the court process.
However, Olamide stated during an appearance on ‘Your View’ on TVC that under the law, if a man recognizes a child as his own, no one else can challenge the child’s paternity.
She emphasized that Mohbad had acknowledged Liam as his biological child during his lifetime, which prevents any contestation.
Olamide further mentioned that as a third party in the matter, it is unlikely that the court will entertain Aloba's request for a DNA test.
She explained, “When a married man and woman have a child, the law presumes that the man is the child’s father unless proven otherwise.
“In this case, Mohbad acknowledged the child as his own when he was alive. Once a man acknowledges a child, no one else can challenge it. A third party like the grandfather is intervening even though the son claimed the child as his until his death.
“If he goes to the court for a DNA test, he will need to provide strong reasons in an affidavit. Also, the person disputing paternity must be part of the proceedings, but the person disputing paternity is deceased.“
