Comedian Pauly Shore and his club, the Comedy Store, are being sued by a comedian who claims that the club’s bouncers assaulted him in December.
Eliot Preschutti, the plaintiff, states that he went to The Comedy Store, owned by Shore’s family, on Dec. 15. According to the lawsuit, he left without paying and was alerted by bouncers and a server that he still owed money and they had his debit card.
Preschutti claims that he instructed the server to process the payment and signed the bill. According to the lawsuit, a bouncer then accused him of trying to hit the server, grabbed him, and threw him to the ground. Other bouncers then started kicking and hitting him for a significant amount of time.
Preschutti alleges that one of the bouncers restrained him and mentioned “this is for Pauly,” referring to Shore, before taking him to an alley and beating him so severely that he “soiled” himself. The bouncers then called the LA County Sheriffs, who detained him until the next morning.
After sleeping for approximately 24 hours, Preschutti went to Cedars Sinai hospital and claims to have suffered “severe physical and emotional damages.” He also states that a part of the assault was filmed and posted online.
He is suing for assault, battery, negligence, premises liability, negligent hiring, aiding and abetting tort, and intentional infliction of emotional distress. He is seeking unspecified compensatory and punitive damages, coverage of legal fees, and any other damages deemed appropriate by the court.
